This is an outline of the terms and conditions of the regulations for staff and employee relations. As a rule, once an employee is contracted for employment, negotiations to determine that relationship are determined at that time but these need to comply with the Employment Act.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-689ca78 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"689ca78\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a0bc88 elementor-widget elementor-widget-heading\" data-id=\"1a0bc88\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Who Is Covered Under The Singapore Employment Act\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aa2a60c elementor-widget elementor-widget-text-editor\" data-id=\"aa2a60c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p dir=\"ltr\">The Singapore Employment Act covers anyone employed by an employer developing a \u201ccontract of service\u201d with that staff member whether a local or foreign employee. This Act includes:<\/p><ul><li dir=\"ltr\" role=\"presentation\">Executives\/Managers: Those in executive and supervisory positions will make relevant decisions, develop strategies or establish policies and manage business operations.<\/li><li dir=\"ltr\" role=\"presentation\">Workmen: These staff will perform manual labour for roughly 50 percent or greater of their daily shift.<\/li><li dir=\"ltr\" role=\"presentation\">Non-workmen<\/li><\/ul><p dir=\"ltr\">Part IV of the Act stipulates that only a portion of the workmen\/non-workmen are given provisions relating to hours of work, rest days, and other service conditions. These include:<\/p><ul><li dir=\"ltr\" role=\"presentation\">Workmen with salaries less than $4500 per month<\/li><li dir=\"ltr\" role=\"presentation\">Nonworkman with salaries less than $2600 per month<\/li><\/ul><p dir=\"ltr\">Some labour groups are excluded with regulation following different Acts based on the nature of their work including:<\/p><ul><li dir=\"ltr\" role=\"presentation\">Seafarers\/seamen<\/li><li dir=\"ltr\" role=\"presentation\">Domestic workers<\/li><li dir=\"ltr\" role=\"presentation\">Government-related staff<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-57aa0d0 elementor-widget elementor-widget-heading\" data-id=\"57aa0d0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What Are Employee Rights And Regulations According To The Singapore Employment Act?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b8d5a74 elementor-widget elementor-widget-text-editor\" data-id=\"b8d5a74\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">A number of common regulations apply relating to employee duties, rights and benefits and those of the employer in Singapore. A summary of those follows.<\/span><b><\/b><\/p><h3><b>Payment<\/b><\/h3><p><span style=\"font-weight: 400;\">The salary period is the time frame when the salary should be paid which should not go beyond a month. The employer will set the date but if they don\u2019t, it will automatically be set at one month. The timeframe will be no later than 7 days after the salary period ends. Overtime payment will be within 14 days after the period ends.<\/span><b><\/b><\/p><h3><b>Rest days &#8211; work hours\/other service conditions<\/b><\/h3><p><span style=\"font-weight: 400;\">This section\u2019s regulation is offer added protections for:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Workmen with salaries less than $4500 per month<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non Workmen with salaries less than $2600 per month<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Executives and managers aren\u2019t covered under these regulations. The guidelines cover the following for these staff:<\/span><b><\/b><\/p><ul><li aria-level=\"1\"><b>Breaks: <\/b><span style=\"font-weight: 400;\">There needs to be a 45 minute break if you work for an 8-hour continuous shift. During a 6-hour continuous shift, there should also be a break.<\/span><\/li><li aria-level=\"1\"><b>Work hours:\u00a0 <\/b><span style=\"font-weight: 400;\">As a rule, normal work hours when working a 5-day week will be 9 hours each day for a 44-hour week. If you work over 5 days in a week, you will work an 8-hour day for a 44-hour week.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The employer and employee can negotiate a contract to further discuss working hours, however, a staff member cannot work longer than a 12-hour shift unless there are extenuating circumstances where the employer makes a specific request. This can include:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An unexpected disruption in work<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Urgent plant or equipment operation<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">National defence, community life, security protections<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Accident or incident<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">There are situations where the employer can make the request for a 12 hour+ shift by submitting an application to \u201cMOM\u201d for permission but the shift cannot exceed 14 hours.<\/span><b><\/b><\/p><ul><li aria-level=\"1\"><b>Overtime: <\/b><span style=\"font-weight: 400;\">Overtime hours exceed the standard working hours\u00a0 excluding breaks. Salary will be\u00a0 at least 1.5 times the basic hourly rate. An employee can only have 72 overtime hours.\u00a0 If an employer needs more than that, they must submit an application to MOM. Exclusions will apply to overtime hours as outlined in the guidelines.<\/span><\/li><li aria-level=\"1\"><b>Rest Days:<\/b><span style=\"font-weight: 400;\"> Stagg members are entitled to a rest day each week without salary which will be decided by the employer. There should only be 12 days maximum timespan between two rest days. If there\u2019s an urgent reason the employee must work on a rest day, the salary should be increased substantially, i.e.\u201d2 days\u2019 salary + overtime pay.\u201d<\/span><\/li><\/ul><h3><b>Holidays<\/b><\/h3><p><span style=\"font-weight: 400;\">Singapore has 11 official holidays with each employee entitled to be paid for these. If the staff is urgently required to work, they should receive a basic day\u2019s salary and then substitute another day agreed upon with the employer to take off. If the holiday falls on a rest day or another non-working day, the staff has a choice to take the next paid day off or for the non-working day, they can choose to receive an extra day\u2019s pay.<\/span><b><\/b><\/p><h3><b>Annual leave<\/b><\/h3><p><span style=\"font-weight: 400;\">When you work for three months with an employer you\u2019re entitled to paid annual leave as follows:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">With 12 months of continuous employment, you\u2019ll receive 7 days of annual leave with an additional day for every 12 months thereafter<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The maximum annual leave allowed is 14 days per year<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">If an employee misses work without a reasonable explanation or without the employer\u2019s permission for 20 percent or more days per month or annually, the employer can take annual leave from the employee.<\/span><b><\/b><\/p><h3><b>Sick leave<\/b><\/h3><p><span style=\"font-weight: 400;\">The employee is entitled to paid sick leave based on their service time with the employer. In order to use sick leave, the staff member needs to offer a medical certificate from a healthcare practitioner for their employer. The doctor needs to be registered under the \u201cMedical Registration Act.\u201d The same is true for dentists, \u201cDental Registration Act.\u201d This will allow you to receive sick pay.<\/span><b><\/b><\/p><h3><b>Employment termination with notice<\/b><\/h3><p><span style=\"font-weight: 400;\">The employment contract can be terminated by either the employee or the employer each of whom have this right when giving adequate notice with the date of termination.\u00a0<\/span><b><\/b><\/p><h3><b>Employment termination without notice<\/b><\/h3><p><span style=\"font-weight: 400;\">Both the employer and the employee have the option of terminating the work contract without giving notice before the contract\u2019s term date.\u00a0 This would involve paying what would have accrued during a typical notice period in gross salary to the other party.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The contract can also be terminated without notice if either the employer or employee violates the contracts terms or conditions purposefully.<\/span><b><\/b><\/p><h3><b>Dismissal<\/b><\/h3><p><span style=\"font-weight: 400;\">An employer has the right to dismiss an employee from their position without notice due to misconduct pertaining to the contract terms or conditions. The employer can also suspend a staff member without pay for a specified period no longer than a week or downgrade their role.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">If the employee feels they\u2019ve been wrongfully dismissed they can submit a claim to be reinstated with back pay or receive compensation as deemed by the Tribunal.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c46e546 elementor-widget elementor-widget-heading\" data-id=\"c46e546\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Final Thought\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-597423d elementor-widget elementor-widget-text-editor\" data-id=\"597423d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">It\u2019s critical to become familiar with the Singapore Employment Act regulations as an employee to understand your rights and as an employer to ensure the contracts you draft are valid.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Dive into The Singapore Employment Act: Your guide to rights, obligations, and workplace regulations.
