Probate Attorney

Position Summary

We are seeking an experienced and detail-oriented Probate Attorney to join our legal team. The successful candidate will manage probate and estate administration matters, represent clients in probate court proceedings, provide legal guidance regarding estate planning and trust administration, and ensure compliance with applicable state laws and regulations.

Key Responsibilities

• Handle probate and estate administration cases from inception through closure.


• Prepare and file probate petitions, pleadings, motions, and related court documents.


• Represent clients in probate court hearings and proceedings.


• Advise executors, administrators, trustees, and beneficiaries regarding estate administration matters.


• Conduct legal research and provide strategic recommendations on probate and estate issues.


• Review wills, trusts, asset inventories, and related estate planning documents.


• Resolve disputes involving estates, trusts, guardianships, and conservatorships.


• Coordinate with courts, financial institutions, appraisers, accountants, and other professionals.


• Maintain accurate case records and ensure timely filing of all legal documents.


• Communicate effectively with clients regarding case status, legal options, and expected outcomes.

Qualifications

• Juris Doctor (J.D.) degree from an accredited law school.


• Active license to practice law in the State of [State].


• Minimum of [2-5+] years of probate, estate administration, and/or estate planning experience.


• Strong knowledge of probate laws, court procedures, and estate administration processes.


• Exceptional legal research, writing, negotiation, and courtroom advocacy skills.


• Ability to manage multiple cases and deadlines simultaneously.


• Excellent client service and interpersonal communication skills.


• Proficiency with legal case management software and Microsoft Office applications.

Preferred Qualifications

• Experience with contested probate litigation.


• Knowledge of estate tax and trust administration matters.


• Board Certification or specialization in Estate Planning and Probate Law (if applicable).
