Our Client is an established and growing business operating 20 early learning centres across Melbourne. The Centres provide care and kinder for children from six weeks until school age and service over 2,600 families collectively. With its Head Office in South Melburne, the Group currently employs more than 1,100 people on both a fulltime and casual basis.
Having achieved substantial growth over the prior eighteen months, it is expected that this growth will continue over the coming years, with a further 10 Centres scheduled to open prior to June 2025.
As well as being a highly successful childcare operator, the business has also established a successful property arm, that has overseen the acquisition and development of six childcare locations in the past 5 years.
About the role
The role of Commercial Manager will sit within the Finance Team and report directly to the CFO. The role will work collaboratively with key stakeholders within the business with a focus on risk minimisation.
Contracts
Review, negotiate and draft a range of commercial contracts such as Agreements for Lease, Commercial Leases, consulting agreements, and service arrangements.
Review and assess key legal and commercial terms to ensure they are in line with appetite for risk.
High level of accurate, commercially strategic advice and support
Good working customer relationships are maintained.
All material risk is identified, and acceptable conditions negotiated.
Facilitates successful conclusion of agreements.
Company Secretarial Compliance
Understanding of basic Secretarial principles and processes
Litigation and Arbitration
Cost effective use of external legal resources.
Unnecessary litigation avoided.
Insurance
In conjunction with the CFO, oversight, and placement of the Groups Insurance Program
Ability to prepare, track and manage insurance claims where appropriate.
Governance and Reporting
Good understanding of governance requirements across the Group and the ability to update relevant procedures and reports where changes in legislation require same
Support governance and risk processes for the Executive Leadership Team
About you
This role is equally suited to an accomplished Legal Practitioner as it is to someone in a Commercial Manager role, where they may be seeking real autonomy and the rare opportunity to assist in building a function in collaboration with an accomplished team. Some of the attributes you may have that will help you succeed in this role are:
Experience and knowledge of key legal principles relating to contracts.
Experience in drafting, negotiating, and advising on commercial agreements, including commercial leasing and property matters
Experience in the design, implementation, and optimisation of contract management processes, including the drafting of policies and procedures, use of technology and training.
Experience of interaction with management levels of a business and a demonstrated ability to build relationships with key stakeholders.
Ability to manage competing priorities within a diverse workload.
Collaborative attitude essential to working in a small, well-coordinated team.
