PRIVACY OFFICER & LEGAL SERVICES

Position Summary
The Privacy Officer acts at the subject matter expert for the organization regarding protection of privacy and access to information. Reporting to the Manager, Risk Services, the incumbent will act as an expert resource to teams across the organization for regulatory requirements, provincial and federal legislation, and providing continual and timely updates to appropriate departments. This includes identifying and developing processes and policies to ensure legislative compliance.
Your Key Responsibilities
Subject Matter Expert in Privacy Matters
- Subject matter expert regarding protection of privacy and access to information both internal to ASEBP and to external providers/partners.
- Act as an expert resource for regulatory requirements, provincial and federal legislation.
- Stay up-to-date with access to information and privacy issues, best practices and orders
- Identify need for and develop policies and processes necessary to ensure compliance with provincial and federal information access and protection of privacy legislation.
- Provide consultative services, assurance and orientation to staff regarding privacy.
- Conduct and/or support privacy impact assessments and cloud suitability assessments for all projects that involve personal information.
- Collaborate with other business units to ensure appropriate administrative, technical, physical and security safeguards are in place to protect the privacy of personally identifiable information.
- Lead investigator on potential/actual privacy incidents/breaches
- Liaise with external partners on shared activities related to breaches or potential breaches.
- Respond to requests for personal information including review of files to ensure that the discretionary and mandatory severance provisions of legislation are applied.
- Respond to privacy and access related complaints and questions from covered members and dependents.
- Prepare reporting regarding access to information requests, privacy incidents and complaints.
- Creatively build and implement awareness of the privacy program and foster a culture of privacy within ASEBP, including Privacy Superstar Program.
Oversight of Retirement Incentive for Teachers and Employees (RITE) program
- Oversee coordination of RITE activities and ensure appropriate deadlines are met including reviewing RITE materials, tracking offers made and preparing RITE reporting.
- Communicate with members and answer questions where applicable.
Assist with Subrogation Processes
- In consultation with ASEBP’s lawyers and Disability services, identify when ASEBP has a right to subrogation. Support legal counsel in compiling and summarizing information for a subrogation claim file including communicating with all parties as needed to recover subrogated funds.
- Follow up on settlement decisions and report claim status.
- Maintain records and report on subrogation settlement decisions
Assist with litigation administration and coordination
- Receive and review Statements of Claim filed by covered members, examine all relevant information to determine cause for legal action.
- Gather information from all pertinent sources creating litigation file
- Maintain ongoing communication with Legal Counsel and leadership throughout proceedings, advising of discovery dates and other relevant information
- Maintain records of litigation processes and related legal fees/expenditures for management/Trustee reporting purposes.
- Coordinate and request the annual litigation report from legal counsel.
Manage Extended Disability Discretionary Settlements
- Receive notification of potential settlement situation (memorandum from Disability Services).
- Create file, gathering and compiling all relevant information; prepares summary.
- Liaise with CEO and AON to determine appropriate and acceptable settlement range
- Communicate settlement offer to covered member and draft and execute the Release and Settlement Agreement
Your Education and Experience
- 3 to 5 years of related experience in a related privacy compliance role.
- Completion of a two to three year technical or community college certificate or diploma.
- Completion of the Information Access and Protection of Privacy (IAPP) program at the University of Alberta, or equivalent.
- Completion of the International Access and Protection of Privacy Certificate is required.
A combination of education and experience may be considered.

- Ability to effectively deal with all internal and external stakeholders in a manner which shows sensitivity, tact, and professionalism.
- Ability to exercise initiative, discretion, and sound judgement in making decisions.
- Excellent customer service focus, including the ability to resolve issues in a fast paced and, often times, politically sensitive environment.
- Demonstrated ability in using MS Office applications.
