Senior Legal Counsel

The role is accountable for ensuring compliance with the Privacy & Data Protection regulations applicable to the Swire Group, as well as implementing and managing compliance with the Group’s data privacy policies across all the countries in which the Group operates. The role also provides legal advice on general commercial and intellectual property matters. 

Responsibilities:

• Provide senior legal advice to operating companies and functional units within the Group on legal and regulatory compliance matters, with a focus on privacy and data protection, IP, and general commercial matters
• Support on IP portfolio management, and provide legal advice on IP, IT, digital and other commercial contracts review
• Serve as DPO to the Company and such other of its subsidiaries as may be required, and as the contact point for data subjects and other relevant data protection authorities
• Support the Data Privacy function in monitoring compliance with privacy and data protection laws applicable to the Group’s businesses, including awareness raising and training 
• Advise the Company of its obligations and any risks under relevant privacy and data protection laws
• Develop appropriate internal corporate policies, practices, guidelines and compliance processes for privacy and data protection, including with regards to collection, accuracy, retention, use, security, transparency, access and correction of personal data
• Report to and work closely with senior management on important privacy and data protection compliance issues, and provide counsel on solutions that best meets the Company’s needs
• Report at various Steering Committee meetings to keep senior management abreast of changes to privacy and data protection laws
• Perform duties consistent with strategic plans and directives as determined by management

To be successful in this role, you must have:

• A minimum of 8 years of post-qualified experience, as a qualified lawyer in an internationally recognized jurisdiction
• At least 4 years’ experience specializing in data privacy and protection laws in multinational companies or international reputable law firms
• Experience in IP, commercial matters, and crisis management is highly preferred 
• An excellent knowledge of privacy and data protection laws and practices in Hong Kong and the Chinese Mainland, including the PIPL. A good understanding of different data protection laws and practices in Asia and worldwide, and regulatory frameworks such as the EU-GDPR is essential
• Attainment of certificates e.g., CIPM, CIPP/E, CIPP/A, CIPIT, is beneficial
• Experience of promoting a data protection culture in a large organization is an advantage
• Solid drafting skills and proven track record in policy and guideline development 
• Sound presentation skills, and the ability to engage senior stakeholders
• Excellent communication skills in both written and spoken English and Chinese. Fluent Putonghua is desirable
