Job Title: Legal & Compliance counsel

Location: Mumbai, Onsite

Job Description: Legal and Compliance Counsel is responsible for leading the Legal and Compliance function in India, strategically identifying and advising on legal and compliance risk, and evolving requirements, laws, and standards, particularly with respect to healthcare regulations. They lead in the design and implementation of programs that support strategic and tactical initiatives across the affiliate in India in alignment with Galderma wide objectives. 

Key Responsibilities

• Providing legal advice/counsel in business-related areas of expertise (e.g., corporate and contract law, transactions/anti-trust, compliance, intellectual property, privacy, employment/labour, corporate governance, ethics, etc.); 
• Proactively providing insights and advice that enable informed decision making 
• To maintain the compliance and risk framework.
• Researching, analysing, and interpreting proposed and existing laws, statutes, and regulations.
• Providing effective and efficient legal advice and support to the Indian affiliate, including:
  a) structuring, drafting, negotiating and/or approving legal contracts, letters of agreement, policies and other documents related to a variety of trade, commercial, financial, and operational matters.
  b) Reviewing advertising and marketing materials to ensure that they are in compliance with legal requisite.
  c) Offering counsel on a variety of legal issue, e.g. Data Privacy, Company Secretary duties, Supplier Due Diligence requirement, litigation & claims related to adverse events.
  d) Providing support in litigation, arbitration, mediation or other disputes with courts, government agencies, or other legal authorities.
  c) Managing external legal counsel on complex legal or compliance issues.
• Plays a lead role in defining, developing and implementing compliance, risk management and monitoring strategies, plans, objectives and metrics. This includes conducting internal risk assessments and investigations, and managing/coordinating investigations initiated by governmental authorities, within budget, in accordance with the strategy agreed with the Corporate Legal and Compliance function.
• Supports continuous improvement of internal practices consistent with the wider legal and healthcare compliance environment within Galderma globally
• Training and development on emerging legal and healthcare compliance, policies and procedures etc.
• Rollout Global Compliance Programs successfully. This includes, but is not limited to, acting as local HCP compliance officer responsible for implementation of global and local Anti-Bribery and Corruption policies and the HCP Compliance Program and associated initiatives including the Galderma Code on Interactions with Healthcare Professionals (HCPs) and Galderma Code of Ethics.

Skills & Qualifications

 Education/Training:

• Degree in law, in combination with life sciences as a preference
• Admission as a legal practitioner in India.
   

Length of employment:

• 8+ years of relevant legal or compliance experience with knowledge and understanding of healthcare compliance and the applicable legal and regulatory framework.
• Sound experience as a Legal Counsel with a mix of in-house in a highly regulated industry.
• Previous corporate communications and training experience is preferred.
• Knowledge of the Laws affecting the pharmaceutical industry.
