Summary of the Business

The NTMA provides a range of asset and liability management services to Government. These services include borrowing on behalf of the Government and management of the National Debt, the State Claims Agency, NewERA, the Ireland Strategic Investment Fund and the National Development Finance Agency. It also assigns staff and provides business and support services and systems to the National Asset Management Agency, the Strategic Banking Corporation of Ireland and the Home Building Finance Ireland.

The NTMA is designated as the State Claims Agency (SCA) when performing the claims management and risk management functions delegated to it under the National Treasury Management Agency (Amendment) Act 2000.
The SCA’s principal objectives are:

  • While acting in the best interest of taxpayers, to act fairly and ethically in its dealings with people who have suffered injuries and who take legal actions against the State or State bodies, and the families of these people; and
  • To implement targeted personal injury and property damage risk work programmes to mitigate litigation risk in State authorities and healthcare enterprises, in order to reduce the costs of future litigation against the State.

The SCA’s remit covers personal injury and third-party property damage risks and claims relating to certain State authorities including the State itself, Government ministers, the Attorney General, the Health Service Executive, the voluntary healthcare sector, An Garda Síochána, the Irish Prison Service, the Defence Forces and community and comprehensive schools. It also manages third-party costs arising from certain Tribunals of Inquiry.

Role Summary

The National Treasury Management Agency has a requirement for Senior Clinical Litigation Solicitor, within the State Claims Agency. 
The successful candidate will work as part of the Clinical Litigation Unit within the State Claims Agency.

Principal Accountabilities

This role will involve undertaking litigation tasks, to include.

  • Managing a designated portfolio of complex clinical litigation files and/or inquest files.
  • Develop and maintain good working relationships with clients.
  • Provide advice on ancillary matters on request.
  • Keep up to date on relevant areas of law and practice.
  • Assist and support to the head of clinical litigation, as required.
  • Such other duties as may be reasonably delegated from time to time.

Skills

  • Excellent communication skills, both verbal and in writing.
  • Ability to work collaboratively with others as part of a team.
  • Willingness to share knowledge, experience, and expertise.
  • Adaptability and flexibility towards the introduction and promotion of new approaches to improve processes.

Knowledge 

  • Qualified to practice as a solicitor in this jurisdiction.
  • Knowledge of the Irish public health sector an advantage.

Experience

  • Minimum of 8 years’ post qualification experience in personal injuries litigation arising from clinical care. Experience of cerebral palsy and catastrophic injuries litigation is required.

Pension Abatement 

If an appointee has previously been employed in the Civil or Public Service and that appointee is entitled to or in receipt of a pension from the Civil or Public Service or where a Civil/Public Service pension comes into payment during the appointee’s re-employment that pension will be subject to abatement in accordance with Section 52 of the Public Service Pensions (Single Scheme and other Provisions) Act 2012.
