Sr Claims Strategist

Job Description

This position acts in an advisory capacity and through analysis, presentation, and resolution (through negotiations, mediation, arbitration, or litigation) of complex cost and schedule damages claims. In order to proactively address contract risk (claims and disputes avoidance) this high-profile position requires regular and frequent interface with Business Lines, Group Controllers and other groups inside and outside the organization including Project Management, clients, vendors, and auditors. Additionally, position works with Fluor's Disputes attorneys and with outside lawyers and consultants to proactively resolve claims and disputes. This role evaluates the financial and schedule impact of claims and makes recommendations to senior management for final action. .Develop a comprehensive approach to claims development and strategy for resolution as required, satisfaction of contractual prerequisites for claim resolution
.Perform analyses of complex claims issues as they relate to the company's business
.Develop significant proposals for contentious change orders for compensation that require formal documentation and substantiation of direct, indirect, and impact costs, including delay and disruption analysis
.Lead staff in monthly review of claims status and associated expenditures they are responsible for
.Assist staff in recording of monthly expenditures of designated claims, including cost reporting, formal reporting, as well as, budget process, as required

Basic Job Requirements

. Accredited four (4) year degree or global equivalent in applicable field of study and ten (10) years of work-related experience or a combination of education and directly related experience equal to fourteen (14) years if non-degreed some locations may have additional or different qualifications in order to comply with local requirements
.Ability to communicate effectively with audiences that include but are not limited to management, coworkers, clients, vendors, contractors, lawyers, claims consultants and other stakeholders
.Job related technical knowledge necessary to complete the job
.Ability to learn and apply knowledge of applicable local, state/province, and federal/national statutes and guidelines
.Ability to attend to detail and work in a time-conscious and time-effective manner

Preferred Qualifications

.Accredited degree or global equivalent in business or finance management/accounting preferred or equivalent business experience in and engineering and construction environment
.Preference for a master's degree or global equivalent in construction management / business or construction law diploma (Bar passage, or global equivalent, not necessary)
.Strong estimating, cost engineering, and project controls background, along with deep understanding of all types of contractual issues
.Must have in-depth knowledge of critical path methods (CPM) scheduling on projects and schedule delay and impact analysis
.Working knowledge of Primavera P6, costing, and overall claims analysis and strategy development
.Ability to identify and analyze legal entitlement arguments and theories
.Experience working with and for attorneys and claims consultants
.Must be detail oriented and analytical
.Outstanding project management, organizational, and critical thinking skills
.Excellent interpersonal and communication skills (written and verbal)
.Strong leadership and decision-making skills

.Demonstrated ability to work with outside counsel and claims consultants, and deal with internal clients at many different levels within an organization
.Must be proficient in the use of computers to include the use of word processing, e-mail, and electronic presentation programs (including PowerPoint)
.Must be highly skilled in the use of spreadsheet and databases used to collect and analyze cost and schedule damages data must possess sufficient skills in order to utilize Fluor's authorized software reporting mechanisms
.Must be skilled in schedule analysis and performance of forensic schedule delay and disruption analysis, including labor productivity analysis.
.Must become proficient in eDiscovery requirements and tools commonly used in litigation.
