Job Summary
The Director of Compliance – Affordable leads the organization’s affordable housing compliance function and ensures managed communities operate in accordance with regulatory requirements, governing agreements, ownership obligations, and company policies. Serving as the organization’s subject-matter expert for affordable housing programs, including Public Facility Corporation (PFC), Housing Finance Corporation (HFC), Low-Income Housing Tax Credit (LIHTC), HUD, and other income-restricted programs, this role provides portfolio-wide compliance oversight, leads the Compliance team, manages regulatory audits and monitoring, supports property transitions and new developments, and establishes scalable policies, procedures, and controls. The Director partners closely with Operations, Ownership, Legal, Accounting, Training, Marketing, IT, and Transitions to translate complex compliance requirements into practical operating procedures and mitigate organizational risk.
Essential Responsibilities
Affordable Housing Compliance Leadership
- Lead the company’s affordable housing compliance program and provide strategic direction across the portfolio.
- Serve as the primary subject-matter expert for PFC, HFC, LIHTC, HUD, income-restricted, mixed-income, and other applicable affordable housing programs.
- Interpret regulatory agreements, land use restriction agreements, partnership agreements, program guidance, and other governing documents.
- Ensure proper implementation of income and rent limits, utility allowances, AMI restrictions, unit set-asides, applicable fractions, tenant eligibility requirements, and other program requirements.
- Oversee LIHTC compliance, including applicable Available Unit, Vacant Unit, Next Available Unit, and minimum set-aside requirements.
- Monitor changes in federal, state, and local requirements and implement appropriate operational changes.
- Develop property-specific compliance guidelines that clearly communicate requirements to regional and property teams.
Audits, Monitoring & Quality Assurance
- Develop and oversee a portfolio-wide compliance audit and quality-control program.
- Establish file-review standards based on program requirements, property risk, ownership obligations, and regulatory requirements.
- Oversee applicant and resident file reviews, certifications, recertifications, and other compliance documentation.
- Coordinate regulatory audits, inspections, monitoring reviews, HUD Management and Occupancy Reviews (MORs), and lender reviews.
- Track findings, corrective actions, recurring deficiencies, and final resolutions.
- Develop corrective action plans and partner with Operations and property teams to resolve compliance deficiencies.
- Identify portfolio-wide trends and implement process improvements to reduce future compliance risk.
Property Transitions & New Communities
- Provide compliance oversight for acquisitions, management transitions, lease-ups, new developments, and newly awarded affordable housing communities.
- Review regulatory agreements and governing documents to identify property-specific requirements, deadlines, restrictions, and potential risks.
- Conduct initial compliance assessments of resident files, unit designations, income and rent limits, reporting obligations, and existing processes.
- Identify inherited compliance deficiencies and coordinate remediation plans with Ownership and Operations.
- Partner with the Transitions team to incorporate affordable housing requirements into onboarding plans.
- Establish compliance calendars, reporting requirements, and operating guidelines for newly onboarded communities.
Compliance Team Leadership
- Recruit, lead, develop, and manage internal and third-party compliance resources.
- Establish departmental responsibilities, workflows, service levels, quality standards, and performance expectations.
- Manage workload and portfolio assignments across the Compliance team.
- Provide coaching, training, and professional development to compliance team members.
- Evaluate staffing, technology, and resource needs based on portfolio growth and program complexity.
- Build scalable processes that support consistent compliance execution across the organization.
Policies, Procedures & Training
- Develop and maintain affordable housing policies, SOPs, checklists, forms, templates, and compliance resources.
- Standardize procedures for leasing, certifications, recertifications, file documentation, unit designation, reporting, and audit preparation.
- Partner with Learning & Development to provide affordable housing compliance training for property and regional teams.
- Communicate regulatory and procedural changes and provide targeted training as needed.
- Maintain accessible resources that help teams understand and execute property-specific requirements.
Operational Partnership
- Partner with Regional and Property Operations to support compliant and efficient property operations.
- Provide guidance on complex applicant and resident eligibility matters.
- Collaborate with Legal, Accounting, Marketing, IT, Training, Transitions, and other departments on matters involving affordable housing requirements.
- Support Marketing with affordable housing advertising, income qualification messaging, and Affirmative Fair Housing Marketing Plan (AFHMP) requirements when applicable.
- Provide compliance guidance for property management software, leasing workflows, forms, reporting tools, and technology implementations.
Risk Management & Reporting
- Develop portfolio-level compliance reporting and key performance indicators.
- Maintain centralized tracking of regulatory reporting, audits, certifications, inspections, affordability requirements, and other critical deadlines.
- Establish risk-based monitoring practices based on program complexity, audit results, file deficiencies, ownership requirements, and regulatory exposure.
- Report significant compliance matters, trends, and emerging risks to executive leadership.
- Recommend operational and procedural improvements to reduce compliance exposure and recurring findings.
- Maintain appropriate documentation supporting the organization’s compliance oversight activities.
Qualifications
- Bachelor’s degree in Business Administration, Real Estate, Housing, Finance, Public Administration, or a related field; equivalent relevant experience may be considered.
- Seven to ten years of multifamily housing experience, including significant affordable housing compliance experience.
- Three to five years of leadership or management experience.
- Advanced knowledge of affordable housing compliance requirements.
- Demonstrated experience with LIHTC and income-restricted multifamily housing.
- Experience interpreting regulatory agreements, affordability restrictions, income limits, rent limits, and program-specific requirements.
- Strong understanding of household eligibility, income and asset calculations, certifications, file documentation, and compliance auditing.
- Demonstrated ability to translate complex regulatory requirements into practical operating procedures.
- Experience leading and developing compliance professionals.
- Strong analytical, organizational, problem-solving, and communication skills.
Preferred
- Direct experience with Texas PFC and/or HFC affordable housing programs.
- Experience managing portfolios with multiple or layered affordable housing programs.
- LIHTC compliance experience in Texas and familiarity with TDHCA requirements.
- Experience working with regulatory agencies, housing finance corporations, public facility corporations, syndicators, investors, lenders, and third-party compliance consultants.
- Experience supporting affordable housing acquisitions, transitions, lease-ups, and new developments.
- Experience implementing compliance technology, centralized file-review processes, or portfolio-wide compliance programs.
