About the Role
EQUES® Law Group is seeking an Associate Level Attorney focused on supporting and building our existing Home Owners and Condo Owners Association practice in Northern Ohio, to join our dynamic team and build a successful practice.
The ideal candidate is an experienced attorney who thrives in a team-oriented environment, is an excellent time and task manager, and is dedicated to delivering high-quality legal representation in every matter. The attorney will consult with and advise client on all stages of the HOA case flow and advocate for client in accordance with the firm values and ethical rules. This role requires an individual who is intellectually honest about their strengths and weaknesses in practice and the business of the delivery of legal services. The candidate must build and foster strong client relationships, contribute to the firm’s overall practice growth, and meet clearly communicated metrics.

Responsibilities
Client Advocacy: Represent HOA clients.
While maintaining a high-volume matter load.
Work with association managers regarding defects and repairs for common elements, and other various matters concerning HOA disputes.
Collect outstanding fees and assessments from homeowners who are not responding to the HOA’s collection efforts.
Advise HOA boards on decisions regarding management, budgets, and legislation.
Drafting:
Draft and amend HOA articles of incorporation, bylaws, covenants, conditions, and restrictions (CC&Rs), and less formal rules and regulations.
Draft policies, covenants, conditions, and restrictions for HOA boards and assist in enforcing documents through courts when necessary.
Draft opinions to HOA boards and management.
Matter Economic Projections: Successfully project the value of services that will be provided, estimate the fees and expenses of representation, and build a matter budget for communication with the firm and client.
Clear Communication and Expectation Setting: Tactfully, thoroughly, and fearlessly communicate the financial obligations of engaging an attorney to the client and maintain a strong strategy of keeping retained funds sufficient to cover the projected time into a matter.
Court Appearances & Litigation: When necessary, represent HOA and COA clients in hearings, trials, and client conferences, advocating effectively in court.
Address disputes regarding violations of CC&Rs; attend enforcement hearings.
Ensure the filing of documents with appropriate courts, administrative agencies, and public and private offices.
Case Management: Oversee and manage legal matters in tandem with a paralegal team, ensuring thorough documentation, strategic planning, and execution.
Communicate with opposing attorneys through personal contact, telephone, and facsimile to expedite cases to a close.
Delegate tasks as appropriate to support staff.
Ensure all client information and documents are appropriately uploaded to client management and document management systems.
Negotiation & Dispute Resolution: Pursue favorable outcomes for clients through settlement, mediation, negotiation, and litigation as necessary.
Cross-Disciplinary Collaboration: Work with multi-disciplinary professionals such as CPAs, social workers, mental health experts, and other professionals to advance the client’s matters.
Strategic Growth & Business Development: Engage in networking, marketing, and community involvement to develop and expand the firm’s litigation (and transactional) practice.
Travel: Travels to off-site meetings regularly.
Confidentiality and Compliance:
Maintain express confidentiality and comply with all other rules of professional conduct.
Comply daily with all court, state bar, and firm rules, regulations, and procedures.
Comply with all continuing legal education requirements.
Attend meetings with firm partners and staff as required.
Collaborate with firm attorneys to support their practices.

Qualifications
JD and admission to the Ohio Bar (Required).
Minimum 3-5 years of HOA experience
Strong leadership skills and the ability to time and task manage with a legal team.
Ability to work efficiently, manage high-stress situations, and effectively organize a legal practice.
Strong written and verbal communication skills.
Tech-savvy and comfortable using case management systems and remote collaboration tools.
Ability to travel occasionally to attend hearings and trials.
