POSITION PURPOSE
The Director of Equal Opportunity and Title IX develops and implements the program, policies and initiatives of the Office of Equal Opportunity and Title IX. The Director also implements, administers and monitors the University's compliance regarding civil rights laws, including federal and state equal opportunity/nondiscrimination laws and regulations, Title IX, the Clery Act, ADA/Section 504, and related University policies. As part of this responsibility, the Director also serves as the University’s Title IX Coordinator and ADA Coordinator. The Director oversees all aspects the University’s prompt and equitable resolution of reports of discrimination, harassment, and retaliation and sexual misconduct. The Director is also responsible for leading new and supporting existing University-wide programs and initiatives designed to prevent discrimination, harassment and sexual violence and provide education to students, faculty, and staff on such issues. In addition, the Director works closely with University leadership, faculty, staff and students to advance the University’s commitment to diversity, equity, and inclusion by improving the University’s capacity to attract, retain, and leverage a diverse campus community in support of academic excellence. The Director is responsible for the strategic and operational functions of the department and serves as the fiscal administrator. This position reports to the AVP of Human Resources. The Director also has a direct dotted-line relationship to the Office or the President.
B. ESSENTIAL DUTIES AND RESPONSIBILITIES
1. Role of Director of Equal Opportunity and Title IX
Provide leadership, direction and supervision for all activities and personnel of the Office for Equal Opportunity and Title IX including consulting with relevant policy-making bodies and senior personnel for the purpose of advising, clarifying and identifying necessary action to eliminate discrimination in all educational programs and activities, and to ensure equal access to facilities, opportunities and resources in compliance with federal and state nondiscrimination laws and regulations; Coordinate University-wide equal opportunity/nondiscrimination and Title IX efforts including the development, implementation, and monitoring of appropriate disclosures, policies, procedures and practices requiring the prompt and equitable resolution of all complaints pursuant to Title IX and equal opportunity/nondiscrimination laws, regulations and University to students, faculty, administrators and staff policies; Oversee and provide leadership for continued development and implementation of University equal opportunity/nondiscrimination policies and resolution procedures that reflect input from the broader campus community and the evolution of changing federal and state regulations pertaining to civil rights investigation and due process requirements; Serve as a consultant and partner with the President’s Office, Provost’s Office, Office of Diversity and Inclusion, Office for Student Life, and with Human Resources with regard to federal and state laws that prohibit discrimination, harassment and sexual misconduct. Prepare quarterly report for the President detailing; current caseload; high profile investigations; appeals in progress; updates on faculty/staff participation in required training workshops; and discrimination complaints filed with external agencies. Oversee equal opportunity/nondiscrimination and Title IX compliance efforts of other campus/school delegates, departments and offices (e.g., deputy Title IX coordinators, investigators, student conduct/discipline, victim services, campus safety, health services, counseling services, student affairs, human resources, faculty/academic affairs, and Athletics, etc.); and Organize and maintain annual database, disposition reports, and other records regarding equal opportunity/nondiscrimination and Title IX compliance, including the development of annual reports of the number and nature of filed complaints and the disposition of said complaints, data collection, climate assessment, and incident/pattern monitoring, etc.; Oversee and manage department budget, including educational programs and materials, and professional development (i.e., outside vendors, investigators, consultants, and retainer agreements).
2. Conduct Consultations, Investigations, and issue Dispositions
Oversee the prompt, effective, and equitable intake, investigation, processing, issuing of findings of fact, and timely resolution (informal and formal resolution) in accordance with University policies and investigation and grievance procedures of all instances of discrimination, harassment, retaliation and/or sexual misconduct made known to responsible employees and/or reported or filed by students, faculty, employees, third parties, or by members of the broader community; Refer complaints or inquiries determined to be inappropriate for further investigation to the appropriate University resource(s) for resolution; Provide appropriate notice of an investigation; determine the extent of an investigation, oversee investigation efforts; ensure provision of initial remedial actions; assure compliance with timelines; deliver appropriate notice of charge, notice of hearing, notice of outcome, duty to warn, and remedies, and provide a repository for and source of institutional record-keeping; Appoint, train, and supervise investigators and any deputy coordinators; Coordinate with with local law enforcement agencies, victim services, district attorney’s office, and others, as necessary and in accordance with operating MOU agreements.;
3. Manage Institutional Monitoring and Compliance
Monitor the University’s compliance with policies against unlawful discrimination, unlawful harassment and sexual misconduct and related procedures to ensure that its policies and procedures comply with Title IX, Clery Act, as amended, the Violence Against Women Act, and other federal and state equal opportunity/nondiscrimination laws and regulations. Serve as principal contact for government inquiries pursuant to equal opportunity/nondiscrimination and Title IX University compliance and supervise the filing of all relevant agency reports as well as additional ones as requested by the president. Oversee and lead efforts to coordinate compliance with University resolution agreements with the US Department of Education Office for Civil Rights, US Department of Justice Office for Civil Rights, and OFCCP, as necessary; Appoint, annually train and oversee Deputy Title IX Coordinators, investigators and other University personnel responsible for investigation or response to incidents of of unlawful discrimination, harassment and/or sexual misconduct, including the Office of Student Life, Human Resources, and the Provost’s Office; Oversee and monitor Title IX and NCAA gender equity compliance in Athletics and Club Sports; Serve as the University’s ADA Coordinator and monitor institutional compliance with and provide ongoing consultation on the Americans with Disabilities Action, as amended, Section 504 of the Rehabilitation Act of 1973, and related federal and state laws pertaining to persons with disabilities; Ensure that appropriate processes are in place to provide for the prompt and equitable resolution of complaints and inquiries from University employees and students, as well as the public regarding compliance with the ADA and other applicable federal and state laws regarding discrimination on the basis of disability; and provide guidance on ADA program and facility accessibility and recommendations on compliance to all sectors of the University community; Manage training for all faculty and staff responsible for implementing applicable grievance procedures; Stay abreast of changes and trends in equal opportunity/nondiscrimination federal and state laws,d rules, regulations and current case in higher education and in the workplace;
4. Equal Opportunity/Affirmative Action (AAP)
Provides leadership and guidance to the University community on equity in all personnel actions and is responsible for development and implementation of the University's Affirmative Action Plans; Maintain, monitor, and audit the University’s EEO/Affirmative Action and programs to ensure the attainment of the University’s goals and objectives; Designs, implement and maintain an EEO audit and reporting system which measures the effectiveness of the University’s Affirmative Action programs, evaluates compliance and determines whether the University’s goals and objectives have been attained in partnership with Human Resources, Provost’s Office, and Office of Diversity and Inclusion; Ensure compliance with OFCCP requirements and regulations and other federal and state guidelines and mandates relative to equal opportunity employment; Communicate to supervisors and managers regarding the University’s EEO/Affirmative Action responsibilities and goals; and Coordinate the implementation of any necessary remedial action to meet AAP compliance requirements and goals.
5. Education, Prevention and Outreach
Oversee the development and implementation of educational programs and initiatives designed to educate and support faculty, staff, and students regarding their rights and, where applicable, obligations under federal and state civil rights laws and regulations, Title IX, including reporting options/responsibilities, support services, University policy and applicable disciplinary code, grievance procedures, confidential resources, etc.; Provide ongoing training, consultation, and technical assistance with specialized training content for hearing officers/boards, investigators, appeals officers, campus safety services and other faculty and staff, as needed; Oversee strategic prevention and awareness efforts aimed at the prevention of discrimination, sexual harassment, sexual misconduct, sexual violence and other forms of sex and/or gender-based discrimination on campus for students, faculty and staff; Develop and disseminate educational materials, including brochures, posters, and web-based materials that inform members of the school or campus community (students, faculty, administers, staff, and parents) of Title IX rights, responsibilities and resources both within and external to school/campus premises; and Hold regular training sessions with managers, employees, and students to ensure that the University meets compliance federal and state compliance requirements.
6. Other Duties and Responsibilities
Review and respond to communications from concerned campus and community members regarding illegal, bias incidents, and other unethical behavior as reported through EthicsPoint and online University monitored reporting systems; Assist the development and preparation of the annual Campus Security and Fire Safety Report, also known as the Clery Report; Serve on the Behavioral Intervention team (BCT) for the proactive response to disruptive, problematic or threatening behaviors on campus; Collaborate in the formulation and implementation of interventions and support strategies for behavioral cases, and appropriately coordinate with other University personnel, campus and community resources, healthcare providers, campus safety officers, government agencies, and family members when responding to students in distress; and Serve on University committees to support diversity, equity and inclusion efforts across campus.
C. PROVIDES WORK DIRECTION
Leads and supervises department personnel and student employees, including work allocation, training, and problem resolution; provides performance management feedback as appropriate.
D. GENERAL GUIDELINES
1. Recommends initiatives and implements changes to improve quality and services.
2. Identifies and determines cause of problems; develops and presents recommendations for improvement of established processes and practices.
3. Maintains contact with University customers and solicits feedback for improved services.
4. Maximizes productivity through use of appropriate tools; planned training and performance initiatives.
5. Researches and develops resources that create timely and efficient workflow.
6. Prepares progress reports; informs supervisor of project status; and deviation from goals. Ensures completeness, accuracy and timeliness of all operational functions.
7. Prepares and submits reports as requested and required.
8. Develops and implements guidelines to support the functions of the unit.
E. QUALIFICATIONS

1. Knowledge
a. Progressive legal background and/or experience in civil rights compliance and thorough knowledge of affirmative action, Title IX, VAWA, Clery Act, and other federal and state laws and regulations applicable to institutions of higher education, including Title VI, Title VII, Title IX, Section 504 of the Rehabilitation Act and ADA.
Significant knowledge and experience conducting investigations alleging discrimination, harassment, and sexual misconduct/sexual violence.

4. Education
Masters Degree required with graduate training in law, higher education administration or other relevant discipline is required.
5. Years of Experience
A minimum of 15 years related progressively responsible leadership experience in higher education required.
Experience supervising Title IX or other civil rights investigators strongly preferred.
