Core Responsibilities:

As the Policy and Compliance Manager for the Division of Licensing and Certification (DLC), you will be responsible for providing oversight and day-to-day management of the Policy and Hearings Unit within Central Operations. This role involves assisting with the development and revision of regulatory rules, as well as coordinating legislative activities and overseeing dispute resolution procedures.

In this position, you will:

•        Assist in drafting revisions and new rules for regulatory compliance and research rules from other states to inform rulemaking processes.

•        Prepare Maine Administrative Procedures Act rulemaking forms and materials, facilitate listening sessions and public hearings for stakeholder input, and coordinate with the Office of the Maine Attorney General, Department of the Secretary of State, and other offices for rule review.

•        Review and edit outgoing correspondence templates and forms for clarity, participate in the Enforcement Accountability Review Panel, manage communication with providers, and research relevant statutes and regulations as needed.

•        Coordinate legislative activities for DLC, including monitoring bills, drafting and editing DLC legislative initiatives, drafting and editing Legislative Action Summaries, Legislative Appraisal Forms, and summarizing committee public hearings and work sessions.

•        Request hearings related to appeals of agency enforcement actions, collect and submit evidence, prepare witnesses, serve as hearings examiner, and collaborate with legal counsel for hearings.

•        Make referrals to the Office of Professional and Occupational Regulation and its licensing boards, and forward complaints to accrediting organizations and investigation summaries to the Office of MaineCare’s Program Integrity and the Attorney General's Healthcare Crimes Unit.

•        Draft Standard Operating Procedures (SOPs) for program implementation and assist in creating and maintaining program manuals.

•        Coordinate Independent Informal Dispute Resolution (IIDR) and Informal Dispute Resolution (IDR) processes following federal and state rules and regulations, and lead informal conference meetings among stakeholders.

•        Supervise the Compliance Officer to ensure the completion of key tasks, including criminal conviction annotation in the Certified Nursing Assistant and Direct Care Worker Registry, rule development, coordination of IDRs, updates of Memorandums of Understanding, and filing hearing requests for involuntary discharges and free care denials.

 

Minimum Qualifications:

An eight (8) year combination of education and/or professional experience in social services to include two (2) years of related program management experience.

The preferred applicant will have:

•        Experience demonstrating applied knowledge of the adjudicatory hearings process following the guidelines and provisions of the Maine Administrative Procedures Act.

•        Knowledge of the practices and principles of public policy planning and formulation.

•        Knowledge of the structure and operations of related state and federal governmental programs.

•        Ability to analyze facts, issues, and testimony, reach logical conclusions, and make sound decisions.
