Job Description - Director, Foreign Regulatory & Compliance

Alliance Trust Company of Nevada is Nevada’s premier trust company, working with attorneys, financial advisors, CPAs and insurance professionals from around the world to provide flexible trust services and the benefits of Nevada trust situs.


 


Alliance Trust Company of Nevada is seeking to fill a full-time remote position within the tax department with a candidate possessing 3+ years of experience in international trust taxation and accounting.  The ideal candidate would have a CPA designation. This position will expose the candidate to a wide variety of US and international tax issues and planning opportunities while still requiring a significant amount of hands-on work.


 


The candidate, at the basic level, would be involved in the technical review, and approval of federal and state tax returns for foreign and domestic trusts with Nevada situs, and assist with the preparation and review of LLC partnership tax return. The candidate will also assist with internal audits and regulatory examinations of the Trust Company. The candidate would work with the organization’s leadership to identify opportunities for, and implementation of, process improvement.


 


Key Responsibilities For Director, Foreign Regulatory & Compliance Include



  • Review the foreign trust structures and ensure fiduciary tax reporting compliance including withholding tax compliance and federal international reporting requirements.

  • Develop internal controls and checks for identifying foreign reporting obligations & assist in robust documentation for fiduciary tax responsibilities.

  • Train staff and colleagues on foreign regulatory and compliance matters from time to time.

  • Review the fiduciary estate administration and estate tax filings for accuracy and correctness including discharge of fiduciary tax responsibilities regarding the estate.

  • Review W8 documentation for various foreign trusts as and when required.

  • Review FATCA filing obligations for fiduciary for foreign trusts where the Alliance Trust Company sponsors foreign trust for FATCA purposes.

  • Review required FATCA certifications from time to time.

  • Compile and file FATCA filings annually as may be required.

  • Review foreign filings in Form 1042 & 1042-S for withholding tax obligations of the trust.

  • Review foreign filings in Form 1120-F for foreign companies under the trust structure as and when required.

  • Review and prepare general ledger accounting entries for trusts of which the Company is acting as trustee.

  • Assist in the preparation of quarterly and annual financial reporting, including budgeting and cash management for trusts, 1099-INT, 1099-DIV, 1099-B, 5498s, etc.

  • Review and reconcile trust bank and investment account reports monthly.

  • Compile and prepare annual trust accountings in accordance with the terms of the trust documents and applicable state laws.

  • Collaborate with other colleagues and service providers for the timely preparation of trust income tax returns and to ensure accurate books and records.

  • Work closely with the Controller and Chief Financial Officer, as well as the Trust Officer in maintaining accounting records and trust administration files.

  • Assist with special requests or projects as requested.


 


Minimum Knowledge, Skills And Abilities



  • Bachelor’s degree in Accounting or Finance.

  • Minimum three (3) years public accounting or foreign trust/estate accounting experience.

  • Experience with fiduciary and entity accounting and understanding of Grantor v. Non-grantor trust for tax purposes.

  • Understanding of trust/estate EIN application requirements

  • Understanding of 65-Day Distribution Rule.

  • Demonstrated ability to implement and manage general ledger accounting and reporting system.

  • Evidence of highly developed communication skills with the ability to explain complex and technical information in verbal or written formats to a variety of audiences.

  • Evidence of flexibility and ability to adapt to changing priorities and ability to multi-task.

  • Computer proficiency, including Microsoft Office, database, internet, and applicable financial and tax software (including excellent Excel skills; SalesForce and Quickbooks experience required)

  • Demonstrated attention to detail and accuracy.

  • Must be highly confidential and display strong judgment. Experience handling sensitive and/or confidential financial information and maintaining ongoing confidentiality.

  • Individual and LLC tax knowledge. 

  • Experience preparing/reviewing IRS Form 1041.

  • Strong accounting, analytical, and research skills.

  • Experience with designing and implementing process improvements.

  • Works well within a team dynamic in a remote/in office environment.

  • Excellent attention to detail.


 


Ideal Candidate for this position will also possess the following:



  • Experience with international trust taxation, estate tax planning, non-profit, and exposure to international/cross-border taxation issues for both US and non-US taxpayers.

  • Experience with foreign tax filing requirements.

  • TNET or other trust accounting platform experience.

  • Experience with new software implementation and data migration is a plus.
